Terms of Use of VIEWER.DENTAL Service

1. GENERAL CONDITIONS


This public offer (hereinafter - Offer) establishes the terms of provision of services of the internet service VIEWER.DENTAL (hereinafter - Service), as well as the mutual rights and obligations of the Operator and User.

The conclusion of a service provision agreement is made by the User's acceptance (acceptance) of the terms of this Offer through the use of the Service.

This Offer may be amended unilaterally. Notifications of any changes will be posted on the Service website. Continued use of the Service by the User after the publication of changes constitutes acceptance of the new terms.


2. DESCRIPTION OF SERVICES PROVIDED


2.1. Primary Purpose of the Service

The VIEWER.DENTAL Service (hereinafter - VEER) is a unique platform for viewing virtual treatment plans, designed for:

  • Orthodontic clinics and laboratories engaged in the manufacture of aligners and other orthodontic devices
  • Specialists in dentistry and orthodontics
  • Patients who need to view virtual treatment plans

2.2. Primary Functionality

The Service provides the following functions:

  • Upload and visualization of three-dimensional models of teeth, roots, and jaw bones
  • Upload and viewing of virtual treatment plans (setups) from popular software (Maestro 3D, 3Shape, etc.)
  • Upload of three-dimensional models (Exocad, Blender, etc.)
  • Customization of the viewer interface in accordance with the user's brand
  • Use of a personal domain name for the Service
  • Management of access to treatment cases
  • Viewing on any device (computers, tablets, smartphones on iOS/Android)
  • Built-in messenger for discussing modeling parameters
  • Personal control panels for doctors and technicians with order history
  • Upload of source data for modeling (3D scans, CT scans, cephalometric images, photos, videos)
  • Adjustment of model display parameters (gloss/matte level, lighting intensity, tissue transparency)

2.3. Pricing Plans

The User selects one of the available pricing plans offered by the Service. Current information on all available plans, their prices, and included features is available on the Service website at https://viewer.dental.

The Service offers flexible pricing options including FREE trial plans and paid STANDARD, STANDARD+, and INTEGRATION plans. For detailed and up-to-date information on pricing, storage capacity, features included in each plan, and additional services, please visit the official Service website.


3. CONSENT TO PROCESSING AND USE OF PERSONAL DATA


3.1. Definition of Personal Data

Personal Data is any information relating to a natural person (user) by which such person can be identified, including:

  • Full name (first, middle, last name)
  • Email address
  • Telephone number
  • Information about the user's account in the Service
  • IP address and data on the use of the Service
  • Other information provided by the user during registration and use of the Service

3.2. Consent to Processing of Personal Data

By using the Service, the User explicitly and unconditionally agrees that:

  1. 1. Their personal data will be collected, processed, and stored by the Operator
  2. 2. The Operator has the right to use personal data for the following purposes:
    • Provision and improvement of the Service
    • Ensuring security, authentication, and account management
    • Sending notifications, information about updates, Service news
    • Technical support and response to user requests
    • Analysis of Service usage to improve functionality
    • Compliance with the requirements of applicable legislation
    • Performance of the terms of this Offer and contractual obligations
  3. 3. Personal data may be processed in Portugal, European Union, and other countries
  4. 4. Processing of personal data is carried out in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR), Portuguese Data Protection Law (Lei n.º 58/2019), and other EU/Portuguese regulations

3.3. Responsibility for Provision of Personal Data

The User guarantees and bears full responsibility for:

  1. 1. Accuracy and currency of provided data - The User agrees to provide only authentic, complete, and current information. The User bears full responsibility for any consequences caused by the provision of inaccurate information.
  2. 2. Legality of provided information - The User confirms that the personal data provided does not violate the rights, honor, dignity, and confidentiality of other persons and complies with applicable legislation.
  3. 3. Right to provide data - The User confirms that they have all necessary rights and authority to provide their personal data to the Operator.
  4. 4. Data protection - The User agrees to exercise care in using the Service and prevent unauthorized access by third parties to their account and personal data.
  5. 5. Notification of changes - The User agrees to promptly notify the Operator of any changes in their personal data.

3.4. Risk Disclaimer

The User understands and agrees that:

  1. - The transmission of information via the Internet is fraught with certain risks
  2. - The Operator does not guarantee the absolute security of personal data during their transmission or storage
  3. - The user provides personal data at his own risk
  4. - The Operator is not responsible for the illegal use of data by third parties as a result of information leakage, hacking or other circumstances beyond the control of the Operator


4. USE OF THIRD-PARTY DATA


4.1. Third-Party Data in the Service

When using the Service, the User may upload, store, and process data that contains personal information about other natural persons (hereinafter - Third-Party Data), including:

  • Personal data of patients (full name, date of birth, contact information)
  • Medical information (images, 3D models of teeth and jaws, photos, videos, diagnostic data)
  • Other information that allows identification of natural persons

4.2. Confirmation of Third-Party Consent

The User guarantees and bears full responsibility for ensuring that:

  1. 1. Consent has been obtained - For each third party whose personal data is uploaded or processed in the Service, the User has obtained explicit, informed consent to:
    • Collection and processing of their personal data
    • Placement of this data in the VIEWER.DENTAL Service
    • Use of this data for the purposes specified in this Offer
    • Transfer of this data to the Operator
  2. 2. Consent is documented - The User has documentary proof of third-party consent (written, electronic, or other) and agrees to provide this proof to the Operator upon first request.
  3. 3. Notification of third parties - The User agrees to notify third parties of the transfer of their personal data to the Service, the purposes of processing, and their rights regarding their data.
  4. 4. Compliance with legislation - The upload and use of Third-Party Data is carried out in full compliance with applicable data protection legislation, including the GDPR and Portuguese data protection laws.
  5. 5. Data deletion upon request - The User agrees to delete Third-Party Data from the Service upon request of the relevant person and upon first request of the Operator.

4.3. Responsibility for Breach

The User bears full responsibility for: any claims by third parties, violation of third-party rights, fines and damages arising from the upload of unauthorized data. The User agrees to fully compensate the Operator for all damages, fines, court costs, and expenses.


5. PROHIBITED ACTIVITY


The User agrees NOT to use the Service for:

  1. 1. Uploading, storing, or processing personal data of third parties without their explicit consent
  2. 2. Violation of the rights, honor, dignity, and confidentiality of other persons
  3. 3. Distribution of confidential, medical, or other sensitive information without permission
  4. 4. Activities that are illegal under applicable legislation
  5. 5. Malicious activity, including distribution of viruses, malware, and spam
  6. 6. Attempts to gain unauthorized access to the Service or accounts of other users
  7. 7. Violation of intellectual property rights of third parties

6. LICENSING AND INTELLECTUAL PROPERTY


All materials, features, information, design, source code, and other elements of the VIEWER.DENTAL Service, including logos, trademarks, interface, graphics, text, and software, are the property of the Operator or its licensors and are protected by intellectual property legislation.

The User is granted a limited, non-exclusive, non-transferable license to use the Service for personal purposes and for conducting professional activities in accordance with the terms of this Offer.

It is prohibited to:

  • Reproduce, adapt, modify, or rework the Service
  • Decompile, disassemble, or attempt to obtain source code
  • Transfer the license to third parties
  • Any other use not provided for in this Offer

7. LIMITATION OF LIABILITY


7.1. Services Provided "As Is"

The Service is provided on an "as is" basis without any warranties, express or implied. The Operator does not guarantee:

  • Uninterrupted or error-free operation of the Service
  • Compatibility of the Service with specific equipment or software
  • Absence of malicious code or viruses
  • Possibility of data recovery in case of loss

7.2. Exclusion of Liability

The Operator is not responsible for:

  1. 1. Loss, damage, theft, destruction, or accidental disclosure of data
  2. 2. Consequences of using the Service, including direct, indirect, special damages
  3. 3. Service interruptions, errors, glitches, maintenance
  4. 4. Actions or omissions of third parties
  5. 5. Unauthorized access to user accounts
  6. 6. Violation of third-party rights committed by the User
  7. 7. Medical, diagnostic, or therapeutic decisions made based on information in the Service

7.3. Limitation of Damages

To the maximum extent permitted by applicable law, the Operator's total liability to the User for any damages, regardless of their nature, does not exceed the amount paid by the User to the Operator in the three (3) months preceding the occurrence of the damages.


8. MODIFICATION AND TERMINATION OF SERVICES


8.1. Right to Modify

The Operator has the right to:

  • Modify the functionality of the Service
  • Temporarily suspend or disable certain features
  • Conduct maintenance without prior notice
  • Modify rates and service terms (with notification)

8.2. Right to Terminate

The Operator has the right to block the user account and terminate the provision of services to the User in the following cases:

  • Violation of the terms of this Offer
  • Upload of unauthorized personal data of third parties
  • Use of the Service for illegal purposes
  • Non-payment in case the service is paid
  • Detection of attempted hacking or malicious activity
  • Upon request of authorities or court order

Upon termination of service, the User is given the opportunity to download their data within 30 days.


9. CONFIDENTIALITY AND SECURITY


9.1. Operator Obligations

The Operator agrees to:

  • Keep personal data and data uploaded by the User confidential
  • Limit access to data to only necessary Operator employees
  • Use technical measures to protect against unauthorized access
  • Comply with the requirements of applicable data protection legislation, including the GDPR and Portuguese law

9.2. Limitation of Obligations

The Operator does not guarantee absolute protection against all forms of unauthorized access, hacking, or data breaches. The User understands that internet use involves certain risks.


9.3. Full Privacy Policy

For detailed information on the collection, use, and protection of personal data, please refer to the Privacy Policy of the Service, available on the website viewer.dental.

11. DISPUTE RESOLUTION


11.1. Applicable Law

This Offer is governed by the laws of Portugal and the European Union, including the General Data Protection Regulation (GDPR). All questions arising from the use of the Service are examined in accordance with Portuguese law.


11.2. Peaceful Resolution of Disputes

In the event of a dispute between the Operator and the User, the parties agree to make every effort to resolve it amicably through negotiations.


11.3. Jurisdiction

In the event that amicable resolution is not possible, any disputes shall be subject to the jurisdiction of the competent courts of Portimão, Portugal, or other competent Portuguese courts.


12. OTHER TERMS


12.1. Entire Agreement

This Offer, together with the Privacy Policy, constitutes the complete and exclusive agreement between the Operator and the User regarding the Service.


12.2. Severability

If any provision of this Offer is found to be invalid or unenforceable, the remaining provisions remain in effect.


12.3. No Waiver of Rights

The Operator's failure to require performance of any condition of this Offer does not constitute a waiver of such right.


12.4. Third Parties

No third parties have rights under this Offer, except as expressly provided for in this Offer.

14. EFFECTIVE DATE


This Offer became effective from the moment of publication on the website https://viewer.dental and remains effective for an indefinite period.

15. ACCEPTANCE OF TERMS


Acceptance of Offer: The fact of using the VIEWER.DENTAL Service means that the User has read, fully understood, and unconditionally agrees with all the terms of this Offer, including requirements for processing personal data, responsibility for third-party data, and all other provisions contained in this document.
